Waiver

SUP Witches Oly Paddle — Participant Waiver, Release of Liability, and Assumption of Risk

In consideration of you accepting this entry, I, the participant, intending to be legally bound do hereby waive and forever release any and all rights and claims for damages or injuries that I may have against SUP Witches of Oly, PNW Events & Market Co, Port of Olympia, Swantown Marina,  RunSignup.com, and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees for any and all injuries to me or my personal property. This release includes all injuries and/or damages suffered by me before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assignees.

Assumption of Risk
Participant understands that paddleboarding, kayaking and canoeing on open water are activities that carry inherent risks, including but not limited to: cold water immersion, drowning, tidal currents, changing weather conditions, collision with vessels or marina structures, equipment failure, and injury from falls or overexertion. Participant further understands that Budd Inlet is a working marina with active vessel traffic, a fuel dock, and guest moorage, and that these conditions present additional hazards beyond open water alone. Participant voluntarily assumes full responsibility for any risk of loss, property damage, illness, personal injury, or death that may result from participation in the Event, whether foreseeable or unforeseeable, and whether occurring before, during, or after the paddle.

Participant Eligibility & Requirements

  • Participant represents that they have prior paddleboard, kayak or canoe experience sufficient to safely participate in an open-water group paddle.
  • Participant agrees to wear a properly fitted U.S. Coast Guard-approved personal flotation device (PFD), a leash and whistle (will be provided to you at check in) at all times while on the water, and understands these will be checked by Event staff prior to launch.
  • Participant agrees to follow all instructions given by Event staff and volunteers before and during the paddle, including staying within the designated paddle area and away from the fuel dock, guest moorage, and channel traffic.
  • Participant certifies that they are physically fit to participate and are not aware of any medical condition that would make participation unsafe.
  • Participant costumes must not restrict movement, vision, or the ability to swim or re-board a board/kayak/canoe; heavy or water-
    absorbent fabrics are discouraged.

Minor Participants
If Participant is under 18 years of age, this Waiver must be read, signed, and dated by a parent or legal guardian, who agrees to all terms above on the minor's behalf and further agrees to indemnify the Released Parties for any claim brought by or on behalf of the minor to the extent such indemnification is enforceable under Washington law.

Medical Authorization
In the event of an illness, injury or medical emergency arising during the event I hereby authorize and give my consent to the Event Director to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization.

Photo & Media Release
Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording of this event for legitimate purposes.

Non-Refundable Fees
This event follows the standard running industry policy: All entry fees are non-refundable. We reserve the right to postpone or cancel the event due to circumstances beyond our control such as a natural disaster or emergency or as required to protect the safety of participants and staff. No refunds will be issued under these circumstances. We reserve the right to change the details of the event without prior notice. I understand that my entry fee is nonrefundable and are non transferable.

Acknowledgment
By submitting this entry, I acknowledge all such risks are known and understood by me. I agree to abide by all decisions of any official relative to my ability to safely complete this event.

I also acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver including the no refund policy.
