Participant Waiver and Release of Liability
In consideration of the acceptance of my entry to participate in the New Year’s Day 2026 5K (the “Event”), I acknowledge and agree to the following:

Assumption of Risk
I understand that running or walking a road race is a potentially hazardous activity. I certify that I am medically able and properly trained to participate in this event. I acknowledge that, although police protection may be provided, there may be vehicular traffic along the course, and I assume all risks associated with participation. These risks include, but are not limited to: falls; contact with other participants, volunteers, spectators, or objects; the effects of weather (including heat, cold, humidity, rain, and wind); and the condition of the course and surrounding area. I knowingly and voluntarily accept all such risks.
Waiver and Release
In consideration of the acceptance of my participation, I, for myself, my heirs, executors, administrators, and assigns, hereby release and discharge Peninsula Track Club, the City of Newport News, Newport News Parks and Recreation, the Road Runners Club of America, York High School, Race Officials, Volunteers, Sponsors, and any of their respective agents, employees, representatives, successors, and assigns from any and all claims or liabilities for death, personal injury, property loss, or damage of any kind arising out of or in connection with my participation in this event, whether caused by negligence or otherwise. This release extends to all claims of every nature, known or unknown, foreseen or unforeseen.
Event Conditions and Refunds
I understand that all entries are final and no refunds will be issued under any circumstances. The Race Director reserves the right to cancel or modify the event at any time due to emergency, hazardous weather, local disaster, or other circumstances beyond control. In the event of cancellation, I acknowledge that I am solely responsible for any personal expenses incurred, including travel or lodging, and that no refunds or credits will be provided.
Media Release
I grant full permission to Peninsula Track Club, York High School, and their authorized agents to use my name, likeness, photographs, video recordings, or other depictions of my participation in the event for legitimate promotional or legal purposes, without compensation.
Minor Participants: Applications for minors (under 18 years of age) will be accepted only with the signature of a parent or legal guardian, who agrees to the terms of this waiver on behalf of the minor participant.
 
I have read and fully understand this waiver and release. I agree to its terms voluntarily and understand that by signing, I am waiving certain legal rights.
